Welcome to Novo Stylist, a service provided by Novo Media and Publishing LLC FZ ("we," "our," or "us"). 1. Definitions
1.1. Client: An individual who registers for an account and uses the services offered by Novo Stylist.
1.2. Stylist: An independent contractor or employee of Novo Stylist who provides styling services to Clients.
1.3 Service: The styling services and related functionalities offered through the Site.
1.4 Subscription: A recurring payment plan for accessing specific services.
2. Acceptance of Terms
By using the Site, you agree to these Terms of Service and any additional terms that may apply to specific sections of the Site or to products and services we make available to you, including third-party services.
3. User Eligibility
To use the Site, you must be at least 18 years old and reside in a country where our services are available. By registering for an account, you confirm that you meet these requirements.
4. Account Responsibilities
4.1. Account Security: You are responsible for maintaining the confidentiality of your account information, including your password. Notify us immediately of any unauthorized access to your account.
4.2. Accurate Information: You agree to provide accurate and complete information when registering and to update it as necessary.
5. Services Provided
Novo Stylist connects Clients with Stylists through our platform. Clients complete a questionnaire, which may be shared with Stylists. We reserve the right to modify or discontinue any services at any time.
6. Payments and Billing
6.1 Payment Processors: Payments are handled by third-party processors such as Stripe and PayPal. By using these services, you agree to their terms and conditions.
6.2 Recurring Transactions: By purchasing a Subscription, you authorize us to initiate recurring payments from your designated payment method until you cancel. Cancellation requests must be submitted through your account settings and will take effect at the end of the current billing cycle.
6.3 Refund Policy: All sales are final. Refunds are issued only in cases where services are not delivered as promised.
7. Client Data and Privacy
By submitting a questionnaire, you consent to the sharing of your responses with Stylists. You agree to receive communications from Novo Stylist, including newsletters and styling assets. Please review our Privacy Policy for information on how we collect, use, and disclose your personal information.
8. Stylist Services
8.1 Stylist Changes: Stylists may change from time to time. We do not guarantee that you will work with the same Stylist throughout your service period.
8.2. Revisions: The number of revisions included in your service package is specified at the time of purchase. Additional revisions may incur additional charges.
9. Fraudulent Activity
In the event of any suspected fraudulent activity, including the use of a fraudulent payment method, we reserve the right to suspend or terminate your account immediately.
10. Account Suspension and Termination
We reserve the right to suspend or terminate your access to the Site or services for any reason, including but not limited to breach of these Terms of Service, suspected fraudulent activity, or any other reason deemed necessary to protect our interests and those of our Clients and partners. Working with Stylist directly outside of the platform is breach of contract and will result in suspension of your account.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Novo Media and Publishing LLC FZ shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or in connection with your use of the Site or services.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved through arbitration in Dubai.
13. Updates to Terms
We may update these Terms of Service from time to time. You will be notified of any significant changes via email or through a notice on our Site. Continued use of the Site after such changes constitutes your acceptance of the new terms.
